The meaning of Ijtihad Tanzeeli (Applied Ijtihad) and its principles in Hanafi jurisprudence

Abstract

The Islamic Shari'ah is the permanent, comprehensive, universal Shari'ah and the source of guidance after abrogation of all the previous Shari'ahs. It contains complete guidance for all aspects of life. Allah Almighty has laid down such principles and rules in the Shari'ah that make it practicable for every time and place. Ijtihad guarantees the perpetuation of Islamic law. The concept of ijtihad was previously limited to ijtihad in devising judgment. But now, the discretionary process comprises of two stages was getting to be progressively imperative from one other and counted incomplete without the other one   which is diligence and hard deductive application. Other   than that, Altenzili diligence is to be studied on the second level of the study.In Hanafi Jurisprudence, there are two types of principles of Ijtihad Tanzeeli. One is that which we interpret as the principle of Ifta ', which is used by the Muftis to perform the duty of Shariah guidance in the traditional Dar-ul-Iftaa. Others are the principles by which the mujtahids per se have differentiated and argued the details and subdivisions in their books. And even in modern times, Jurists have devised many new principles by viewing the significance of some pertinent issues of collective nature, and are carrying out the duty of implementing and releasing the rules.This article will introduce the concept of Ijtihad Tanzeeli and its two types of principles.
